Terms and Conditions

1. Who we are

The Wagoi mobile application and related services (the “Service”) are operated by Wagoi Ltd., a company to be incorporated under the laws of Malta. References to “Wagoi”, “we”, “us” or “our” refer to that entity. Contact: hello@wagoi.eu.

2. Acceptance of these Terms

By creating a Wagoi account, signing in, or otherwise using the Service, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the Service.

You must be at least 16 years old (or the minimum age of digital consent in your country, whichever is higher) to use the Service.

3. Your account

  • You are responsible for keeping your sign-in credentials confidential and for all activity under your account.
  • You agree to provide accurate information and to keep it up to date.
  • We may suspend or close your account if you breach these Terms, abuse the Service, or attempt to circumvent its protections.

4. Connecting your vehicle

The Service allows you to connect a supported vehicle through manufacturer or third-party APIs (e.g. Tesla Fleet API, Smartcar). You confirm that you are authorised to grant Wagoi access to that vehicle’s data.

The Service is read-only with respect to your vehicle: Wagoi does not send commands that lock, unlock, drive, charge, or otherwise operate the vehicle. Some manufacturer scopes may technically permit commands; Wagoi has chosen not to use them.

5. Tokens, rewards and subscriptions

  • Wagoi may award in-app tokens for activity such as signups, referrals, streaks, and connecting a vehicle. Tokens have no cash value and cannot be redeemed for fiat currency.
  • Token amounts, eligibility rules and partner discount codes may change at any time. We will make reasonable efforts to communicate material changes.
  • Paid subscriptions (e.g. Wagoi Plus) are billed through Apple App Store, Google Play, or Mollie and are subject to those providers’ terms. The sign-up date is the renewal anchor; cancellation keeps your tier active until the end of the current period; no pro-rata refunds.

6. Acceptable use

You agree not to:

  • Use the Service for any unlawful, fraudulent, or harmful purpose, or to abuse referral, signup, or reward mechanics (including via duplicate accounts, fake vehicles, or fabricated VINs).
  • Attempt to gain unauthorised access to other users’ accounts, vehicles, or data.
  • Interfere with, disrupt, or circumvent any rate limit, anti-abuse, or security control.
  • Resell, sublicense, or commercially exploit the Service without our prior written consent.

7. Intellectual property

The Service, the Wagoi name and logo, and all related software, designs and content are owned by Wagoi or its licensors and are protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable licence to use the Service for personal, non-commercial purposes in accordance with these Terms.

8. Reverse engineering

You may not reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Wagoi mobile application or any associated server components, except:

(a) to the extent expressly permitted by Article 5(1) of Directive 2009/24/EC of the European Parliament and of the Council on the legal protection of computer programs — namely acts necessary to use the program for its intended purpose, including error correction; or

(b) to the extent expressly permitted by Article 6 of Directive 2009/24/EC — decompilation strictly necessary to achieve interoperability with other software, where the information needed is not otherwise readily available.

Any such permitted activity must be promptly disclosed to security@wagoi.eu before public disclosure, and you must give us a reasonable opportunity to address any underlying security or interoperability issue.

9. Privacy and personal data

Wagoi processes personal data as described in our Privacy Policy. By using the Service you confirm that you have read that Privacy Policy. Granular processing consents (analytics, marketing, telemetry, etc.) are managed in the in-app Consent Center.

10. Third-party services

The Service relies on third-party platforms including (but not limited to) Apple, Google, Tesla, Smartcar, inMotiv, fal.ai, PostHog, Sentry, Firebase Cloud Messaging, Brevo, Mollie and OVH Cloud. Use of those services is governed by their own terms. We are not responsible for outages, errors or data quality issues originating in third-party services.

11. Beta features and changes

Wagoi is under active development. Features may be added, modified, or removed at any time, and some features may be offered as beta, preview, or experimental. Beta features are provided “as is” and may be discontinued without notice.

12. Disclaimers

To the maximum extent permitted by applicable law, the Service is provided “as is” and “as available”, without warranties of any kind, express or implied. Wagoi does not warrant that the Service will be uninterrupted, error-free, accurate, or secure. Vehicle-derived data (range estimates, efficiency, locations, valuations) is indicative and must not be relied upon for safety-critical decisions.

13. Limitation of liability

To the maximum extent permitted by applicable law, Wagoi shall not be liable for any indirect, incidental, special, consequential or punitive damages, including loss of profits, data, goodwill or vehicle use. Our aggregate liability arising out of or in connection with the Service shall not exceed the greater of (a) the amount you paid Wagoi in the twelve months preceding the event giving rise to liability, or (b) one hundred euro (€100). Nothing in these Terms excludes liability that cannot lawfully be excluded under Maltese or EU consumer law.

14. Termination

You may stop using the Service at any time and may request deletion of your account at wagoi.eu/delete-account. We may suspend or terminate your account if you breach these Terms, for security or legal reasons, or upon discontinuation of the Service.

15. Governing law and jurisdiction

These Terms are governed by the laws of Malta, excluding its conflict-of-law rules. Subject to mandatory consumer protection rights in your country of residence, any dispute arising out of or in connection with these Terms shall be submitted to the exclusive jurisdiction of the competent courts of Malta.

Consumers resident in the European Union retain the right to bring proceedings in the courts of their country of residence and to rely on mandatory protections of their local law.

16. Changes to these Terms

We may update these Terms from time to time. Material changes (major-version bumps) are communicated in-app and require renewed acceptance before continued use. Minor clarifications and editorial fixes (minor or patch versions) do not require re-acceptance. The version of these Terms is shown at the top of this page; previous versions remain accessible at /terms-and-conditions-vX-Y-Z.
